Board-and-train Agreement and Liability Waiver

This Agreement is made between Resilient Rover LLC ("Trainer") and the undersigned dog owner ("Client") regarding the temporary boarding and training of the Client’s dog ("Dog") in Trainer’s private residence.
The Client agrees to the following terms:
1. Services Provided & Expectations
a. The Dog will reside in Trainer’s home for a period ranging from one (1) day up to thirty (30) days, receiving daily training and care in a home environment.
b. Trainer’s own dog may or may not be present during the stay. If Trainer determines that the dogs do not safely coexist, Trainer will board their own dog elsewhere at the Client’s expense, resulting in a higher-tier rate (the "Solo Stay Rate"). The Client acknowledges that this adjustment may be necessary at any time during the Dog’s stay, including if the dogs initially get along but later develop issues. The Client will be billed for any rate increase as soon as reasonably possible.
c. Trainer will provide a documented training plan in advance of the stay, along with daily recaps of the Dog’s progress, unless the Client requests a different frequency of updates (e.g., due to travel or time zone constraints).
d. While Trainer will implement structured training to improve behavior and will provide documentation of progress, no specific training results are guaranteed. Training success depends on multiple factors, including reinforcement by the Client after the Dog returns home.
2. Feeding & Medication
a. Client must provide all necessary food and medication, along with written feeding and medication instructions.
b. Resilient Rover will provide training treats while considering the Dog’s dietary restrictions (e.g., avoiding chicken if an allergy is noted).
c. If food runs out, Trainer will feed a high-quality alternative food at a per-meal cost to be billed to the Client.
d. Dogs will be fed in separate rooms with doors closed to prevent competition or conflict.
3. Sleeping Arrangements & Resource Management
a. The Dog may sleep anywhere in the house if it can do so safely. If competition arises over sleeping spaces (e.g., the human bed), Trainer will crate the Dog overnight, or provide a safe alternative such as a playpen, dog bed, or access to a different room in Trainer’s home.
b. Toys, blankets, and other enrichment items will be provided. However, if resource guarding occurs, these items will be removed for safety.
c. Choking hazards will be minimized, and inappropriate items will be removed (e.g., socks, dryer sheets) if the Dog attempts to chew on them.
4. Health, Vaccinations & Veterinary Care
a. Client must provide proof of current vaccinations before drop-off, including rabies, distemper, parvo, and bordetella.
b. If vaccines or preventatives (e.g., flea/tick, heartworm) are out-of-date, the stay will be denied.
c. Client must designate a veterinarian and pre-authorize payment for any emergency or routine care needed during the stay.
i. Client remains financially responsible for all veterinary or medical costs arising from the Dog’s actions, including injuries to Trainer’s animals, other animals, or people.
d. Client must also provide homeowner’s or renter’s insurance details and, if applicable, pet insurance details in case a claim needs to be filed.
5. Liability, Damages & Indemnification
a. General Liability & Safety Measures
i. While the Dog is in Trainer’s care, financial liability for bites or injuries is primarily the Client’s responsibility. Trainer maintains General Liability coverage, but Client agrees to indemnify and defend Trainer against claims to the fullest extent permitted by law.
ii. Trainer reserves the right to adjust training equipment as needed for safety, including use of a muzzle, crate, or harness.
b. Dog Behavior & Early Termination
i. Client affirms that they have fully disclosed the Dog’s behavioral history, including but not limited to any incidents of aggression, bite history, resource guarding, reactivity, or other dangerous tendencies.
ii. Client acknowledges that failure to disclose such history constitutes a material breach of this Agreement and agrees to indemnify Trainer for all resulting damages, costs, or claims.
iii. If aggression, excessive barking/howling, or unsafe elimination emerges and cannot be managed, Trainer may terminate the stay early. Client must designate a backup caregiver who can assume responsibility immediately.
c. Damage to Property
i. If the Dog damages Trainer’s personal property (e.g., furniture, flooring, clothing, electronics), Client will be billed for reasonable cost of repair or replacement.
ii. Daily-use dog training items such as dog toys, towels, leashes/collars, dog beds, and blankets are exempt from damage charges, and Client will not be billed for these items.
d. Third-Party Injury or Claims
i. Client agrees to indemnify, defend, and hold harmless Trainer, its agents, and employees against any and all third-party claims, damages, or liabilities (including attorney’s fees) arising from the Dog’s actions, whether occurring on or off Trainer’s premises.
e. Bite Incidents, Reporting & Cooperation
i. Client acknowledges that bites or other incidents involving the Dog may be subject to reporting, quarantine, observation, or other requirements imposed by applicable state or local law.
ii. Client shall be primarily responsible for making any legally required animal-bite report concerning the Dog when the Dog is returned to or under Client's custody, and shall promptly provide Trainer with confirmation of any report made and any instructions received from the applicable agency.
iii. Notwithstanding the foregoing, Trainer may report any bite or other incident to animal control, public health, law enforcement, an insurer, veterinarian, event organizer, property owner, or other appropriate person or agency whenever Trainer reasonably believes reporting is required by law, contract, insurance requirements, public safety considerations, or prudent professional practice.
iv. If Trainer has custody or control of the Dog when an incident occurs, Trainer may make any report required of Trainer by applicable law and may take reasonable steps necessary to comply with quarantine, observation, identification, vaccination-verification, or other governmental requirements.
v. Client shall promptly provide Trainer with all information and documentation reasonably necessary for reporting or investigation, including Client contact information, Dog licensing information, vaccination and rabies records, veterinary information, insurance information, and known behavioral history.
vi. Client agrees to cooperate fully with Trainer and applicable authorities regarding any bite investigation, quarantine, dangerous-dog proceeding, insurance claim, or related matter.
f. Trainer Injury / Assumption of Risk Reversal
i. If the Dog causes injury to Trainer, Trainer’s staff, or Trainer’s animals, Client agrees to be fully financially responsible for resulting medical or veterinary expenses, unless caused by Trainer’s gross negligence or reckless conduct.
ii. Client acknowledges that Trainer does not assume the risk of injuries caused by Client’s Dog and expressly accepts responsibility for such risks.
6. Communication & Emergency Protocols
a. Client must provide a reachable form of communication (e.g., phone, WhatsApp, or email) and respond to Trainer’s messages within 24 hours. If the client will be unreachable for extended periods (e.g., backcountry hiking, international travel) the client must arrange a backup point of contact in the San Francisco Bay Area for Trainer while Client is out of reach.
b. Trainer will provide daily updates/recaps to client unless client requests less frequency.
c. In the case of a bite or health issue, Trainer will notify client immediately, but will not wait for a response from Client to take appropriate action (e.g.: visit the veterinarian).
d. In the event of natural disasters (e.g., earthquake, fire, flood), every reasonable effort will be made to ensure the Dog’s safety. However, Client acknowledges that Trainer is not liable for acts of God that result in injury, escape, or fatality.
e. Client must provide the name and contact details of a local emergency contact authorized to retrieve the Dog immediately if required.
7. Payment, Reservation Deposit, Transportation & Cancellations
a. Reservation Deposit
A reservation deposit equal to one (1) day of the applicable Board-and-Train rate is required to hold the Client’s requested dates. The reservation is not confirmed and the dates are not held until the deposit is received. The deposit will be applied toward the total cost of the Board-and-Train stay.
b. Cancellation & Deposit Refunds
Client acknowledges that Trainer reserves the scheduled dates for Client and may modify Trainer’s business schedule and availability in reliance on the reservation. If Client cancels the Board-and-Train reservation, the following refund policy applies:
i. More than seventy-two (72) hours before the scheduled start of the stay: Client will receive a one hundred percent (100%) refund of the reservation deposit.
ii. Between seventy-two (72) hours and forty-eight (48) hours before the scheduled start of the stay: Client will receive a fifty percent (50%) refund of the reservation deposit.
iii. Less than forty-eight (48) hours before the scheduled start of the stay: The reservation deposit is non-refundable.
c. Pickup & Dropoff Options
Within one (1) week before the scheduled Board-and-Train stay, Trainer will provide Client access to available Home Pickup and Home Dropoff appointment times through Trainer’s online scheduling system. Available appointments will be based on Trainer’s then-current geographic zone schedule.
i. In-Zone Home Pickup & Dropoff — No Charge. Client may select an available Home Pickup and/or Home Dropoff appointment that corresponds with Trainer’s current schedule for Client’s geographic zone at no additional charge.
ii. Appointment Availability. Pickup and dropoff appointments offered through the scheduling system are based on Trainer’s zone schedule in effect at the time the appointments are offered. Available appointments are subject to change and are valid through the end of the day on which they are offered. Client acknowledges that Trainer may periodically modify its geographic zones, zone assignments, days, hours, and service schedule.
iii. Pickup or Dropoff Outside the Zone Schedule — $20 Each. If Client cannot accommodate the available in-zone appointment times but requires Home Pickup and/or Home Dropoff at another mutually agreed-upon time, a $20 surcharge will apply to each service. If Client requires both Home Pickup and Home Dropoff outside the available zone schedule, the total surcharge is $40.
iv. Client Dropoff & Pickup — No Charge. As an alternative to Home Pickup or Home Dropoff, Client may drop off and/or pick up the Dog at 1601 Mariposa St, San Francisco, CA 94107 at no additional charge.
v. Additional Board-and-Train Days. If Client selects an available in-zone Home Pickup or Home Dropoff appointment that requires the Dog’s stay to begin earlier or end later than the originally scheduled Board-and-Train dates, the additional day or days will become part of the Board-and-Train stay and will be charged at the applicable daily Board-and-Train rate.
vi. Home Pickup and Home Dropoff are separate services and may be arranged independently under the terms above.
8. Release of Liability
a. Client understands and voluntarily accepts all risks associated with boarding and training services, including but not limited to risk of injury, illness, escape, stress behaviors, minor scuffles, and environmental risks.
b. Client waives any and all claims against Trainer, its owners, and agents, and agrees to indemnify Trainer from any damages, costs, or liabilities related to the Dog’s stay, except those arising from Trainer’s gross negligence or reckless conduct.i. Risk of injury, illness, escape, or stress-related behaviors in the Dog.
c. This Agreement is governed by the laws of California, and Client remains liable for the Dog’s actions under all applicable state, county, and city ordinances.
9. Media Release
a. Client grants Resilient Rover LLC permission to photograph/video the Dog for training documentation and promotional purposes unless otherwise specified in writing.
